About the early adopter program
Terms and Conditions
- To apply to Midwinter’s early adopter program (the “Program”) you must submit an application form with all requested information at midwinter.com.au/earlyadopter.
- You may apply for the Program at any time. However, Midwinter reserves the right to decline your application in accordance with the terms and conditions below. If selected, you may choose to opt out of the Program at any time by notifying Midwinter at [email protected]
- By applying for the Program, you will be deemed to have accepted the following terms and conditions:
a. Your application to the Program remains subject to Midwinter’s approval and Midwinter reserves the right, at its discretion, to accept or decline your application, including on the basis of your suitability for the Program or if the maximum number of participants has been reached;
b. Midwinter reserves the right to remove you from the Program if Midwinter considers that you are in breach of these terms and conditions, no longer suitable to participate in the Program, or not actively participating in the Program;
c. Your participation in the Program does not entitle you to receive, and Midwinter is not obliged to make available, any particular benefits. Midwinter may, at its discretion:
i. select certain groups of Program participants to participate in closed beta or design testing;
ii. provide Program participants with early access to new features, products or services at a discounted price and for a limited period of time through open Beta testing programs; and
iii. change the benefits available under the Program or discontinue the Program entirely at any time;
d. All information disclosed or made available by Midwinter to you in connection with the Program will be the confidential information of Midwinter and you:
i. may only use Midwinter’s confidential information for the purpose of participating in the Program;
ii. shall not disclose Midwinter’s confidential information to any other third party without the prior written consent of Midwinter; and
iii. shall, upon request from Midwinter, return or destroy any Midwinter confidential information that you have received (inlcuding any copies of such information);
e. The obligations above relating to Midwinter confidential information will not apply to any information which subsequently becomes publicly available, other than by breach of these terms and conditions by you;
f. All rights (including intellectual property rights), title and interest in and to the following belong to Midwinter:
i. any software or products made available by Midwinter in connection with the Program; and
ii. any ideas or feedback provided by you through the Program, inlcuding in any webinar or as part of any open or closed beta testing;
g. Your use of any Midwinter software or products in connection with the Program, including as part of any design or beta testing programs, will be subject to Midwinter’s acceptable use policy here and any other terms of use advised by Midwinter from time to time; and
h. Any personal information collected by Midwinter as part of your application or otherwise in connection with the Program will be managed by Midwinter in accordance with its privacy policy here.
